problem with e-bay seller

hi

i won a model helicopter on e-bay and payed for it the same day by paypal,
this was on the 22/12/03

after 10 days i contacted the seller asking were my item was, i was told he
was out of stock and would send it to me as soon as he got them back in,
after another 5 days i contacted him again, he then tells me he wont have
them untill the 14 jan and will post it as soon as he gets it, on the 17 th
jan i contacted him again he then tells me he had him shipment taken by
customs, then on the 19th he tells me its in the post, i got my item on the
24 th jan, i had left feedback on e-bay saying he was very slow with
delivery, he responed to the feedback saying i had changed my address, this
was not true, now here is the real problem, he was selling a heli simler to
a skyhawk , a small remote controll helicopter, but when i opened it it was
one of these bummbulebeee things and not what he was trying to sell on e-bay

his i.d on e-bay is    Jatt-uk

please stay away from this guy, he tells lies and you dont get what you
payed for, i have complained to e-bay, we will see what they will do about
it if anything, i know others have had the same problem with this guy

Send the item back and demand a refund, if he refuses to pay out take
him to court via the internet. http://www.moneyclaim.gov.uk you will
get your £30 court fee back if you win the case.

Is it worth the stress and hassle????

Just put it down to bad experience and be careful what you buy off eBay.

I cant see ebay lasting in the future tbh as it`s full of scams, crap, and
fake items, not to mention non bidders.
Seems to be full of idiots with big mouths too!

Well,,, there is two sides to every coin and I must say in Ebays defence
that I have had a good year trading on ebay with nether a bad deal coming or
going. I have a 100% feedback in excess of 170 and made over £5000 in 1
year. I have also spent £7000 (ouch!) so I have a little way to go to break
even! For the newcomer it is full of trader traps and one has to be aware
and sniff out the background of the trader BEFORE making a bid. Dont be put
off, just avoid all those flashy Ads and if it sound too good to be true, it
probably is!!

YES IT IS WORTH IT.

If you can fill out a webform, you can take someone to court VERY
easily. All it asks is your name, their address, amount claimed and
the reason why you are claiming.

i did know of any problems with this guy untill after a i had payed for the
item, and had not recived it after a few days waiting, yes i have contacted
e-bay about this problem, and i know of at least one other person that got
done as well, and yes i checked his feedback before bidding, there was
nothing wrong that i could see, i put the problem on here hopeing to stop
anyone else getting done by this guy

Why did you even bother? He was selling an item he didn't have, which isn't
allowed on Ebay, and it's clearly not an error (ie. he had 5 when he thought
he had 6), so I'd have asked for a refund and told him to stop dicking around.

Then neg him for illegally (by Ebay's rules) selling something he didn't have.

Hind sight is a wonder thing to have. IMO I think your comments are overly
too critical.
To be fair to the buyer he paid soon after the auction and *could* not have
known that the seller was selling something he didn't have.
I'm being presumptuous here, but I sense that the OP is maybe an
inexperienced ebay user and hence posted here (and other groups) to share
his experience and hopefully warn others of this seller. The fact that he
could and should have requested a refund or force one via Paypal maybe never
occurred to him.

Les, get his phone number out of the ebay contact forms and ring him
up. Use the court as the last resort.

Ring him up and say you want a refund, pure and simple.
Tell him if he refuses, you won't many alternatives but to take steps
to reclaim your money. Casually mention towards the end of the
conversation but don't threaten that it could lead you taking the
matter up in the courts. If you ring him and whine down the phone,
he'll probably tell you to go ahead and do whatever you want. It's
also worth sending a letter via recorded delivery to his address. It
doesn't matter if he doesn't respond, but at least it will show that
you did try and give him a chance to resolve it.

The item is not as described and not what you paid for.
Very clear case and I think the judge will award you all your money
back.

Don't let it drag on for too long either. The quicker you can file the
case, the better it is all round. I'd give him a deadline of 10 days
to refund you all the money and if he doesn't, take it to court.

That's still not your problem. Get him to refund and keep his shoddy business
practices to himself.

Didn't you have the 'discussion' about top / bottom posting in the DVD
newsgroup a couple of years ago?

I can't believe you've still got that bee in your bonnet.

Unfortunately, some people top post and some bottom post.

I the newsreader programs automatically forced a bottom post then that would
save any variances!  But, they don't.  The majority of people will use
Outlook Express to read, reply and partake in Newsgroups such as this and OE
defaults to Top Posting!

Personally, if I've followed a thread I don't want to have to read through
every message again to read the next post which is 'supposed to be' at the
bottom of the thread!

Anyway, Les, the advice that you have been offered is sound advice.  Good
luck and thanks for letting other users know of your difficulties.
